How to recover maintenance arrears in an HOA

Practical steps to recover overdue maintenance fees: notice, formal demand, penalties, payment plans and court action, with digital evidence.

Maintenance arrears hit association liquidity directly: unpaid bills, delayed suppliers, neighbour tension. Law 196/2018 and internal rules allow penalties and recovery measures, but sequence and documentation matter.

Step 1: clear per-unit ledger (balance, ageing, penalties). Step 2: friendly notice (SMS, email, noticeboard). Step 3: written demand with a deadline. Step 4: payment-plan offer if the assembly/committee allows. Step 5: court action / enforcement with a complete file.

Without evidence (payment lists, delivery confirmations, penalty resolutions), recovery is slow. A digital system that marks receipt confirmation, archives PDFs and keeps conversation history dramatically shortens time to collection.

Online payments (card at the noticeboard, payment links) reduce new arrears: the “no time to pay cash” barrier disappears. Easy collection plus firm pursuit of old debts is the most effective mix.

Tip: report monthly to the committee the arrears top list and collection rate. When KPIs are visible, decisions (plans, legal action) happen faster and fairer.
